Policing and Criminal Justice (PCJ) Data Protection Directive

As forecast in our latest blog on the topic (available here), the European Parliament today voted into law a new General Data Protection Regulation (“GDPR”) that will replace the EU’s all-encompassing Data Protection Directive as of mid-2018.

After three months of legal-linguistic checks and translations, the EU is poised to formally adopt the new EU General Data Protection Regulation (GDPR) and its sister law, the EU Policing and Criminal Justice Data Protection Directive (PCJ DPD).

The new and likely final texts for approval were released late on Wednesday, April 6; the GDPR text can be found here, whilst the final text of the PCJ DPD can be found here. We have also published automated comparisons here and here, for the GDPR and PCJ DPD respectively.

Documents recently released by the Council of the EU (available here and here) suggest that the Council will vote to endorse these final texts by the end of this week (Friday April 7, 2016), before passing them on for approval by the European Parliament during next week’s plenary sessions (April 11-14, 2016).

Today, the first meeting between the European Parliament (“EP”), the Council and the Commission (called “trilogue”) took place with the aim of reaching an agreement on the General Data Protection Regulation (“GDPR”) by the end of the year.  (For background, please see our previous InsidePrivacy post on the Council’s recently agreed general approach.)  The three EU institutions also discussed the status and timetable for the trilogue negotiations on the proposed Data Protection Directive in the law enforcement context (“Law Enforcement DP Directive”).

Right after the meeting,  the EP’s rapporteur on the GDPR, Green MEP Jan-Philipp Albrecht, the Chair of the Civil Liberties, Justice and Home Affairs (‘LIBE’) committee, S&D MEP Claude Moraes, justice ministers from the outgoing (Latvia) and incoming (Luxembourg) Council Presidencies, and the EU Commissioner for Justice, Consumers and Gender Equality, Věra Jourová, gave a joint press conference on the state of play of the talks and next steps.
